Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and AllesMind ("we", "us"). By creating an account or otherwise using AllesMind (the "Service") you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility & account

• You must be at least 13 years old (16 if you are in the EU).
• You are responsible for keeping your password confidential and for all activity that happens under your account.
• One account per person; do not share login credentials.
• You must give us accurate, current information when registering.

3. Your content

You keep all rights to the documents, images, and text you upload, as well as to the mind maps you create. You grant us only the licence we need to operate the Service: storing your content, serving it back to you and to anyone you explicitly share an unlisted link with, processing it through our AI provider to generate or modify mind maps, and creating routine backups.

You are responsible for your content. You confirm that:

• You own it, or have the necessary rights and permissions to upload it;
• It does not infringe any third party's intellectual-property, privacy, or other rights;
• It does not contain unlawful, hateful, harassing, or sexually explicit material involving minors.

We may remove content or suspend accounts that breach these rules.

4. Acceptable use

You agree not to:

• Reverse-engineer, scrape, or automate the Service in ways that bypass plan limits or quotas.
• Use the Service to generate spam, phishing, malware, or content that violates the Anthropic Acceptable Use Policy (which applies because we route requests through their AI).
• Probe, attack, or attempt to disrupt the Service.
• Resell or redistribute the Service or any AI output as a hosted product without our written permission.

5. Plans, credits & payment

The Service is offered on a freemium basis. Paid plans and credit packs unlock higher limits. Pricing, features, and credit costs are shown on the homepage / pricing page and may change with reasonable notice for new purchases or renewals.

Payments are processed by Paddle.com Market Limited, our merchant of record. Paddle handles billing, currency conversion, fraud screening, and applicable VAT / sales tax. By purchasing you also agree to Paddle's checkout terms.

5.1 Subscriptions

Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account page; access continues until the end of the paid period and the plan reverts to Free thereafter.

5.2 Credits

Credits are consumed when you generate a mind map. Unused credits do not expire while your account is active. Credits are non-transferable and have no cash value.

5.3 Refunds

Subscription payments and credit-pack purchases are refundable within 14 days of purchase if you have not consumed any credits associated with that purchase. To request a refund, email support@allesmind.com with your order number; refunds are processed by Paddle and typically appear within 5–10 business days. Statutory consumer-protection rights (including under the South African Consumer Protection Act) are not affected.

6. AI-generated output

AllesMind produces structured mind maps using a large language model. AI output can contain inaccuracies, omissions, or biased framings — review it before relying on it for any important decision. You are responsible for verifying AI output before sharing or acting on it.

To the extent permitted by law, output is provided to you "as is" and ownership of the output you generate transfers to you on creation, subject to the licence we keep to operate the Service (see §3).

7. Service availability

We aim to keep AllesMind available, but we do not guarantee uninterrupted service. Maintenance, third-party outages (notably the AI provider), or force-majeure events may cause downtime. We do not credit accounts for short outages; significant disruptions will be addressed case-by-case.

8. Suspension & termination

We may suspend or terminate your account if you breach these Terms, abuse the Service, or expose us or our processors to legal risk. You may close your account at any time from the account page; your data will be deleted as described in our Privacy Policy.

9. Disclaimer & limitation of liability

The Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to the Service is limited to the greater of (a) the amounts you paid us in the 12 months before the event giving rise to the claim, or (b) USD 100. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill — even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes liability that cannot be excluded by law (for example, for death or personal injury caused by negligence, or for fraud).

10. Changes to the Terms

We may update these Terms from time to time. Material changes will be announced by email and the "Effective" date at the top of this page will be updated. Continued use after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of South Africa. Any dispute will be brought before the competent courts of South Africa, without prejudice to mandatory consumer protections available where you live.
